Froglingo License Agreement

1. This agreement is the complete and exclusive agreement between Kevin Xu, the OWNER of the Froglingo system, and you, the CUSTOMER. The terms and conditions of this agreement prevails over any conflicting or additional terms of any oral or written quote, acknowledgment, proposal, declaration, warranty, or any communication between the parties. No modification of this agreement will be binding, unless in writing and signed by an authorized representative of each party.

2. The OWNER grants the CUSTOMER a non-exclusive, non-transferable, worldwide, royalty-free copyright license for using the software including the documents of the Froglingo system. The executable code and the documents of the froglingo system can be used with no charge, but only for non commercial purposes such as education and evaluation, and not for any other commercial, business, governmental, military, non-profit use. Websites that use the Froglingo system must display a link to http://www.frogling.com

3. The Froglingo system is provided "AS IS" without a warranty of any kind. All express or implied representations and warranties, including any implied warranty of merchantability, fitness for a particular purpose are hereby excluded. The OWNER will not be liable for any consequential, incidental, indirect or special damages whatsoever.

4. This agreement is effective until terminated. Customer may terminate the agreement at any time by simply destroying all copies of the software. This agreement will terminate immediately without notice from the OWNER if the customer fails to comply with any provision of this agreement. Upon termination, the customer must immediately destroy all software copies.
